In accordance with the Personal Data Protection Act 2010

This Personal Data Protection Notice (“Notice”) describes how Klinik Pakar Wanita Liu & Vincent Sdn Bhd and/or its healthcare professionals (“KPWLV” or “Clinic”) and [iCAS] (“the App") use your Personal Data. KPWLV and our healthcare professionals respect the privacy of individuals with regards to their personal data (“Personal Data”) and is committed to protecting the privacy of our patients (“Users”) and strives to provide a safe and secure customer experience. This privacy policy is formulated in accordance with the Personal Data Protection Act 2010 (“Act”), which describes how your Personal Data is collected, processed and used and your choices with respect to your Personal Data.

DESCRIPTION OF PERSONAL DATA

1. Personal Data means personal information about you, from which you are identifiable. KPWLV will process your personal data such as mentioned below (including without limitation) which have been provided by you and/or discovered during the process of your treatment as a patient at the Clinic and/or any information about you that has been or may be collected, stored, used and processed by KPWLV from time to time.

• name;
• race;
• religion;
• nationality;
• NRIC no. and/or passport no.;
• KPWLV Registration no;
• contact address, email, telephone no. and fax no.;
• date of birth and age;
• employment and Place of Employment and other employment details;
• medical notes and medical History Notes and Details of all medical and /or surgical intervention and treatments ;
• results of all Diagnostic Tests;
• Credit and Debit Cards No. and other details;
• Your Insurance company and policy no. and other details pertaining to your insurance policy

2. The provision of Personal Data is mandatory if you intend to seek healthcare services in KPWLV. If you do not provide your Personal Data, KPWLV is unable to register your information and thus, unable to render the healthcare services to you.

SOURCES OF PERSONAL DATA COLLECTED

3. In addition to the Personal Data you provide to KPWLV directly, KPWLV may also collect your Personal Data from a variety of sources, including without limitation when you register with KPWLV as patient, employees, business associates and other related parties with KPWLV, from KPWLV agents or other third party referring agents.

PURPOSES OF PERSONAL DATA COLLECTED

4. KPWLV may use and process your Personal Data for the purposes relating to the business and activities of KPWLV which shall include, without limitation:

• to facilitate treatment for your medical condition;
• to maintain customer and patient database and customer and patient related processes;
• for insurance claim purposes;
• for billing and financial purposes including collection of payments for KPWLV’s services rendered to you and all other related transactions, accounting, auditing and tax;
• for bad and doubtful debts collection;
• to meet legal and statutory requirements including but not limited to requirements from government ministries, departments and agencies;
• for contact and enquiry purposes;
• for administrative and internal statistical analysis purposes;
• for investigating complaints and grievances;
• for defending KPWLV in malpractice and other claims irrespective of whether the claims involve court proceedings or otherwise;

and you agree and consent to KPWLV using and processing your Personal Data in the manner as identified above and in this Notice.

5. KPWLV may also use and process your data for other purposes such as to send you updates and news on their latest products, services and promotions including the latest KPWLV projects and developments and to inform you about events, exhibitions or roadshows which may be of interest to you, by way of social media, post, telephone calls, short message service (SMS) and/or by email.

6. If you do not consent to KPWLV processing your Personal Data for the purposes listed in Section 5 please notify KPWLV using the contact details stated in Section 13 below.

DISCLOSURE OF YOUR PERSONAL DATA

7. In processing your data KPWLV may disclose your personal data to the following parties: · your insurance companies, third party insurers, employers of patients, guarantors and/or credit reporting agencies/credit data management company operating in Malaysia; · KPWLV’s information technology service providers and related medical equipment and supplies providers; · government Ministries, departments and agencies; · Healthcare professionals such as registered medical practitioners, registered dental practitioners, registered nurses, registered medical assistants, technologist, allied health staff, paramedical staff or other healthcare staff engaged or referred to for the provision of healthcare services in accordance with the Private Healthcare Facilities and Service and Service (Private Clinic and Other Private Healthcare Facilities) Regulations 2006; · our appointed lawyers and debt collectors in the event of delay in or default of payments due to us and in the process of defending KPWLV against Malpractice claims and other claims; · any other parties as instructed or consented by you.

8. Your Personal Data may also be shared in connection with a corporate transaction, such as merger, consolidation, or in the unlikely event of winding-up.

LINKS TO THIRD-PARTY WEBSITES

9. This app may contain links to third parties’ websites. Please note that KPWLV is not responsible for the collection, use, maintenance, sharing or disclosure of data and information by such third parties. If you provide information directly to such sites, the privacy policy and terms of service on those sites are applicable and KPWLV is not responsible for the information processing practices or privacy policies of such sites.

INCOMPETENT PATIENTS

10. In order to provide healthcare services to our patients, KPWLV knowingly collect Personal Data from Incompetent Patients. Incompetent patients include patients who are certified medically to be mentally incompetent or who is legally incompetent or he/she is a minor who has not attained the age of 18 years old. In the event that such Personal Data is provided to KPWLV, you, as legal guardian hereby consent to the processing of the Incompetent Patient’s Personal Data and personally accept and agree to be bound by this Notice and take responsibility for his or her actions.

CHANGES TO NOTICE

11. We reserve the right to amend this Notice from time to time without prior notice. We advise that you check this Notice on our Website on a regular basis.

13. In respect of your right to access and/or correct your Personal Data, KPWLV has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law.

CONSENT

14. KPWLV seeks to use your Personal Data only for the purposes of legitimate interests and, with your consent.

15. We at KPWLV will not use your Personal Data for a purpose that has not previously been specified, unless we have previously obtained your consent or unless such purpose is required by law.

16. Subsequent with this notice, if you do not consent to KPWLV processing your Personal Data, you can withdraw your consent to our collection, use or disclosure (generally Processing) of your Personal Data by contacting Personal Data Protection Personnel as shown in Section 13 of this notice.

17. Accordingly, we believe that you will consent to and agree with the terms above with respect to the processing of your personal data. If we have not received any response from you regarding the above, we reserve the right to assume that you agree with the above.
